Swiss trademark registration for international brands

Switzerland sits outside the EU trademark system. An EU registration gives you nothing in Switzerland; a separate Swiss right is required.

We protect brands in Switzerland through the international route under the Madrid Protocol or through a direct national filing with the Swiss Federal Institute of Intellectual Property, working with Swiss correspondents where the procedure requires a domestic address for service. Combined with our UK and EU practice, one instruction protects your brand across the registers that matter to you.

Fixed fees agreed in writing before filing. Official fees are confirmed at cost on the day of quotation.

Unpaid invoices from Swiss customers

Switzerland operates a creditor friendly first stage of debt enforcement that does not require a court judgment to begin. We prepare and manage that process for foreign creditors end to end, from the formal demand through the Swiss enforcement request, working with a Swiss domestic representative as the procedure requires.

If the debtor formally objects, the matter moves to the Swiss courts. Our role is everything up to that point, and where court proceedings become necessary we hand over to Swiss litigation counsel who quote their own fees, with the file fully prepared.

We also advise on securing Swiss assets on the basis of enforceable judgments and arbitral awards.

Swiss market access for foreign financial firms

Foreign wealth managers, advisers, brokers and fund distributors serving clients in Switzerland face registration and conduct duties under the Swiss Financial Services Act, including entry of client advisers in the Swiss register of advisers and affiliation with an ombudsman.

The exemptions are narrower than most firms assume. Serving wealthy private clients who have opted up to professional status does not by itself take you outside the regime.

We deliver the registration file, the conduct documentation and the ombudsman affiliation as one fixed fee package. For financial intermediaries establishing in Switzerland we manage self regulatory organisation affiliation under Swiss anti money laundering law, and fintech authorisation projects. Our founder secured a Swiss regulatory registration for a digital asset business at first attempt.

Swiss data protection for international companies

The revised Swiss Federal Act on Data Protection applies to companies outside Switzerland that offer goods or services to people in Switzerland.

If your business is GDPR compliant you are close, but not finished. Switzerland imposes its own notice, record keeping and breach reporting duties, and some foreign companies must appoint a representative in Switzerland.

We assess whether the representative duty applies to you, close the gap between your GDPR documentation and Swiss requirements, and arrange a Swiss representative where one is genuinely required. The assessment comes first, so you only pay for what the law actually demands of you.

English law contracts built for Swiss deals

There is no fast treaty route for enforcing a UK court judgment in Switzerland. An arbitration award, by contrast, is enforceable in Switzerland under the New York Convention and can ground the attachment of Swiss assets.

Can you advise on Swiss law?

No. We advise on English law and on UK and EU trademark procedure. Where Swiss law is decisive we bring in correspondent Swiss counsel and agree the cost with you before anything is incurred.

Do I need a UK trademark if I already have a Swiss one?

Yes, if you trade in or sell into the United Kingdom. Swiss registrations have never covered the UK, and EU registrations stopped covering it after Brexit. A separate UK filing is required.

Will advice from an English solicitor be privileged in Switzerland?

We state this openly so you can choose counsel with full information: advice from foreign counsel may not attract legal privilege under Swiss procedure in the way advice from a registered Swiss attorney does. For contentious Swiss proceedings you need a Swiss attorney. For English law and UK or EU trademark work, you do not.

How are fees charged?

A fixed fee in CHF, agreed in writing before work begins, valid for 30 days from the date of the quote. No hourly billing. Official fees are passed through at cost and stated separately.

Who regulates you?

Does my EU trademark cover Switzerland?

No. Switzerland is not in the EU trademark system, so an EU registration gives you no rights there. Protection comes either by designating Switzerland under the Madrid Protocol from an existing base registration, or by a direct national filing.

Can you recover a debt from a Swiss company?

Yes, up to the point of contested court proceedings. The Swiss first stage of enforcement can be started without a judgment, and we run that for foreign creditors through a Swiss domestic representative. If the debtor formally objects the matter moves to the Swiss courts, and we hand the prepared file to Swiss litigation counsel who quote their own fees.
