Common questions

FAQs.

Someone registered my brand as a domain name. Can I get it back?

Usually, yes, without going anywhere near a court. If the domain is confusingly similar to your name or trademark, the registrant has no legitimate interest in it, and it was registered or used in bad faith, a UDRP complaint (for .com and most global domains) or a Nominet DRS complaint (for .uk domains) can order the domain transferred to you. Decided on the papers, typically within 60 days for UDRP.

Do I need a registered trademark first?

A registered trademark is the strongest foundation and makes bad faith far easier to prove, but unregistered rights built through trading can also succeed. If you have no registration, the smart sequence is often to file the trademark and the complaint strategy together, and we handle both under one roof.

What is the difference between UDRP and Nominet DRS?

UDRP covers .com, .net, .org and most global domains, decided by panels at WIPO or Forum. Nominet DRS covers .uk domains and includes a free mediation stage before an expert decision. Both are paper-only procedures: no hearings, no court, a written complaint decided by a specialist.

The registrant is demanding money for the domain. Should I pay?

Paying rewards the squat and prices the next one. A demand for money above out-of-pocket costs is itself evidence of bad faith registration, which strengthens the complaint. Send us the correspondence before replying to anything.
