Do I really need a solicitor for a commercial lease?

A commercial lease is often a five-to-ten-year liability worth many multiples of the legal fee. Repair clauses, rent review mechanisms, break conditions and personal guarantees are where tenants lose money, all of them are negotiable before signature and almost none of them after. A fixed-fee review costs £750; a badly drafted full-repairing obligation can cost tens of thousands.

What is a contracted-out lease?

A lease excluded from the security-of-tenure provisions of Part II of the Landlord and Tenant Act 1954, so the tenant has no automatic right to renew. The exclusion is only valid if the statutory notice and declaration procedure is followed precisely before the lease is completed, this is exactly the kind of step we handle.

Can you act if the property is anywhere in England or Wales?

Yes. Lease drafting and review is document work: it does not depend on where the property is, and the whole matter is handled remotely by email and video.

Do you handle the sale or purchase of the property itself?

No. Sale and purchase conveyancing involves holding client money, which sits outside this practice by design. Leases, licences, variations and surrenders, everything that is drafting and advice rather than completion monies, is in scope.

How fast can you turn a lease review around?

A standard review with a written report on the key risks is normally delivered within 3 working days of payment; urgent turnarounds are available at the Counsel tier.

Which parts does an authorised solicitor handle?

Certain execution and registration steps on lease deeds are reserved legal activities under the Legal Services Act. This practice handles the advisory, drafting-in-negotiation and settlement of terms, and instructs an authorised conveyancing solicitor for those reserved execution and Land Registry steps where the law requires, inside the same fixed fee structure, with the split stated in your engagement letter. You always know who is doing what.
